‘James Bond’ in fight to keep name following legal challenge from luxury property developer

The iconic James Bond name is at risk of losing its trademark protection following a legal challenge from Austrian businessman Josef Kleindienst, a property developer based in the United Arab Emirates.

According to The Guardian, Kleindienst has filed multiple lawsuits—referred to as “cancellation actions based on non-use”—against various versions of the James Bond trademark. These include James Bond 007, James Bond Special Agent 007, James Bond: World of Espionage, and even the legendary phrase, “Bond, James Bond.”

Under trademark law, if a registered name is not actively used for specific goods or services for a period of five years, it becomes vulnerable to cancellation. Kleindienst’s case targets areas such as “models of vehicles,” “computer programs and electronic comic books,” and “electronic publishing,” alleging that these trademarks have not been commercially utilized by Eon, the long-time stewards of the Bond franchise.

A spokesperson for Kleindienst confirmed to The Guardian that if successful, he intends to develop projects under the James Bond name, teasing an imminent “announcement.”

The legal battle is currently unfolding in the European Union, with Kleindienst filing cancellation actions on January 27th. However, he is also expected to submit similar filings in the UK.

Intellectual property expert Mark Caddle, a partner at European firm Withers & Rogers, provided insight into the case, explaining, “He is challenging multiple UK and EU trademark registrations for James Bond. The argument is that the name has not been actively used for the goods and services it protects, which is likely the basis for the UK filings as well.”

As of now, Eon Productions—the company behind the James Bond film franchise—has yet to publicly respond to the challenge. The outcome of this case could have significant implications for the future of the Bond brand, potentially opening the door for new commercial ventures under the legendary spy’s name.
